You receive protection from lawsuits by legally distancing yourself from the business. This is done by creating a separate legal entity. Think of it as giving birth to a legal document ;) The name of the business has no bearing on your protection from lawsuits. Yes, you should incorporate. Go to your local Clerk of Courts office, ask some questions and go from there. Incorporating, at least for a single individual that solely owns one business, should not cost thousands of dollars.
